End-user license agreement

As mentioned on the Terms of use page, obtaining and using any Application is subject to the terms set forth herein, referred to as the “End-User License Agreement” or “EULA”.

The terms “Weeblr”, “Applications”, “Application”, “Site”, “Desktop application”, “Desktop applications”, “Browser extension”, “Browser extensions”, “Mobile app”, “Mobile apps”, “Online app”, “Online apps” and “Service” are defined on the Terms of use page.

EULA

Please read this EULA carefully before downloading, installing, or using an Application. By downloading, installing, or using an application, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms and conditions of this EULA, do not download, install, or use the Application.

1. License Grant

Subject to the terms of this EULA, Weeblr grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on a device that you own or control.

2. Restrictions

You may not: (a) copy, modify, or distribute the Application; (b) reverse engineer, decompile, or disassemble the Application, or attempt to derive the source code from the Application; (c) create derivative works based on the Application; (d) remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Application; (e) use the Application for any purpose that is illegal or prohibited by this EULA; (f) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Application to any third party.

3. Intellectual Property

The Application, including but not limited to all copyrights, trademarks, patents, trade secrets, and other intellectual property rights, are and shall remain the sole and exclusive property of Weeblr, with the exception of open-source software mentioned at paragraph 4 below. This EULA does not convey to you any rights of ownership in or related to the Application.

4.Open-Source Software

The Application may include third-party open-source software components. The copyrights for these components are owned by their respective authors. The terms of the open-source licenses under which these components are used within the Application and distributed with it are available on our Credits. Weeblr disclaims any warranty or liability obligations to the extent allowed by the applicable open-source licenses.

5. Privacy

By using the Application, you agree to the terms of our Privacy Policy, which is available on our Privacy policy page.

6. Updates

Weeblr may, from time to time, provide updates or upgrades to the Application. You agree that Weeblr has no obligation to provide any updates or upgrades or to continue to provide or enable any particular features or functionality of the Application.

7. Termination

This EULA is effective until terminated by you or Weeblr. Your rights under this license will terminate automatically without notice from Weeblr if you fail to comply with any term(s) of this EULA. Upon termination of the license, you shall cease all use of the Application and delete all copies of the Application from all devices where you use it.

8. Disclaimer of Warranty

The application is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement. Weeblr does not warrant that the functions contained in the application will be uninterrupted or error-free, that defects will be corrected, or that the application or servers that may make it available are free of viruses or other harmful components. Weeblr does not warrant or make any representations regarding the use or the results of the use of the application in terms of its correctness, accuracy, reliability, or otherwise.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Weeblr be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the application, even if Weeblr has been advised of the possibility of such damages.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within the State of Delaware, and the parties hereby consent to the personal jurisdiction and venue of such courts.

11. Changes to this EULA

Weeblr reserves the right to modify this EULA at any time. Any changes will be effective immediately upon posting the updated EULA on this website. Your continued use of the Application after the posting of the updated EULA constitutes your acceptance of the changes.
